Terms of Service
These terms are the agreement between you and Bobby, Inc. for using our app and services across New York City. Please read them carefully.

1. Agreement to these terms
These Terms of Service (“Terms”) are a binding agreement between you and Bobby, Inc. (“Bobby,” “we,” “us”) governing your access to and use of the Bobby mobile app, website, and related services (together, the “Platform”). By creating an account, booking a service, providing a service, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
These Terms include an agreement to resolve disputes by binding arbitration and a waiver of class actions (Section 15). Please read it carefully.
2. Definitions
- Customer, a user who books and pays for a service.
- Provider, an independent contractor (including drivers, cleaners, sitters, caregivers, chefs, barbers, and other professionals) who offers and delivers services through the Platform.
- Booking, a confirmed request for a service between a Customer and a Provider.
- Bobby Fee, the flat platform fee described in Section 5.
- Content, any text, images, ratings, messages, or other material submitted to the Platform.
3. Eligibility & accounts
You must be at least 18 years old and able to form a binding contract to use the Platform. You agree to provide accurate account information, keep it current, and keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly through the contact method Bobby publishes at launch if you suspect unauthorized use. Providers must additionally complete identity verification and, where applicable, background checks and licensing required for their service category (for example, TLC licensing for ride-hailing).
4. Bobby's role as a marketplace
Bobby is a technology platform that connects Customers with independent Providers. Bobby does not provide the underlying services itself and is not the employer, agent, or partner of any Provider. Providers are independent contractors solely responsible for the services they deliver, including their quality, timing, safety, licensing, and compliance with law. Any contract for services is directly between the Customer and the Provider. Bobby is not a party to that contract except to facilitate booking, communication, and payment.
5. Pricing & the $1 fee
Bobby charges a flat $1 fee per booking, never a percentage commission. The Customer pays the Provider's stated price, standard card-processing charges billed at cost by our payment processor (Stripe), and the $1 Bobby Fee; the Provider keeps 100% of their price. The only exception is food delivery, which carries a flat $2 fee ($1 to the restaurant and $1 to the driver). Ride-hailing fares are calculated from official New York City Taxi & Limousine Commission (TLC) metered rates, shown upfront before you confirm. The full price you pay — the Provider's price, card processing, the Bobby Fee, and any taxes or tip — is displayed before you confirm a booking. Fees may change prospectively; the fee in effect at the time you book applies to that booking.
6. Payments, tips & taxes
Payments are processed by our payment provider, Stripe. Bobby does not store full card numbers. By confirming a booking you authorize Bobby to charge your selected payment method for the Provider's price, applicable card-processing charges (at cost), the applicable Bobby Fee, any taxes, and any tip you choose to add. Tips are optional and paid in full to the Provider. You are responsible for any taxes applicable to your use of the Platform except taxes on Bobby's net income. Providers are responsible for reporting and paying their own taxes.
7. Cancellations & refunds
Cancellation windows and any cancellation or no-show fees are disclosed before you confirm a booking and vary by service. If you cancel within a free window, you are not charged the service price. Refunds for cancelled, incomplete, or disputed services are handled through in-app support and issued to your original payment method where approved. Some fees (for example, a driver's compensated no-show fee) may be non-refundable where clearly disclosed.
8. Provider terms
If you offer services as a Provider, you additionally agree to the Provider Agreement. You represent that you are legally permitted to perform your services, hold all required licenses and insurance, and will perform them competently and safely. You set your own price and schedule and may accept or decline bookings, consistent with your independent-contractor status.
9. Acceptable use
You agree not to:
- use the Platform for any unlawful, fraudulent, or harmful purpose;
- harass, threaten, discriminate against, or endanger any person;
- circumvent the Platform to avoid fees, or solicit payment off-platform in a way that removes Customer protections;
- misrepresent your identity, licensing, or eligibility;
- interfere with, scrape, reverse-engineer, or disrupt the Platform or its security;
- submit false, infringing, or misleading Content.
10. Safety, ratings & suspension
To keep the community safe, Bobby uses identity verification, two-way ratings, real-time trip tracking, trip-sharing, and an in-app SOS feature for rides. We may investigate reports and may suspend or terminate any account that violates these Terms, poses a safety or fraud risk, or as required by law. You may stop using the Platform at any time and may request account deletion as described in our Privacy Policy.
11. Intellectual property
The Platform, including the Bobby name, logo, and software, is owned by Bobby, Inc. and protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to use the app for its intended purpose. You retain rights to Content you submit but grant Bobby a worldwide, royalty-free license to host, display, and use it to operate and improve the Platform.
12. Disclaimers
The Platform is provided “as is” and “as available.” To the fullest extent permitted by law, Bobby disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Bobby does not warrant that services booked through the Platform will meet your expectations or that the Platform will be uninterrupted or error-free. Providers are independent; Bobby does not guarantee their acts or omissions. Any identity verification, background checks, ratings, or other safety features Bobby may offer are provided on a reasonable-efforts basis, may be limited or unavailable, and do not guarantee any Provider's conduct, suitability, qualifications, or your safety. Services such as transportation, childcare, elderly care, and in-home work carry inherent risks; to the fullest extent permitted by law, you assume those risks and are responsible for exercising your own judgment before and during any booking.
13. Limitation of liability
To the fullest extent permitted by law, Bobby and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Platform or from any Provider's acts or omissions. Bobby's total aggregate liability for any claim relating to the Platform will not exceed the greater of the fees Bobby earned from your bookings in the six months before the claim, or one hundred U.S. dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Indemnification
You agree to indemnify and hold Bobby harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Platform, your Content, your violation of these Terms, or, for Providers, the services you deliver.
15. Disputes & arbitration
Most concerns can be resolved by contacting support first. Except where prohibited by law, you and Bobby agree that any dispute will be resolved by binding individual arbitration rather than in court, and you and Bobby waive the right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms through the contact method Bobby publishes at launch. These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules.
16. Changes & contact
We may update these Terms from time to time. Material changes will be notified in the app or by email, and the “Last updated” date will change. Continued use after changes take effect means you accept the updated Terms. Questions? A contact address for general questions and legal notices will be provided when Bobby launches.
